A. General part

§ 1 General information

  1. Personal data are individual details about your personal or factual circumstances, i.e. data which identify you or which can be used to determine your identity. This includes, for example, your correct name, address, telephone number or date of birth. Personal data also includes personal data, i.e. data without direct reference from which a person can be derived, such as the IP address.

  2. Personal data includes data which is generated in connection with the retrieval of www.dvvmedia-webinar.com by your client (browser) and stored in so-called log files on the servers of DVV Media and the technical service providers.

  3. On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation and security of our services), we collect data on every access to the server on which the service is located (so-called server log files) in accordance with Art. 6 Para. 1 lit. f GDPR.

  4. These are the name of the website accessed, file, your IP number, date and time, browser type and the requesting provider.

  5. Log file information is stored for security reasons (e.g. to clarify abuse or fraud) for a maximum of seven days and then deleted. Data whose further storage is required for evidence purposes are excluded from deletion until the respective incident has been finally clarified.

  6. When you visit the pages of DVV Media, personal data will also be automatically processed in anonymised form. This includes usage data such as the beginning and end of your visit, the pages you call up or the length of time you stay on the portal. This data is not used for personal purposes.

  7. DVV Media collects, processes or uses personal data only in compliance with the relevant data protection regulations. This means that the users' data will only be processed if legal permission has been granted. This means, in particular, if the data processing is necessary or legally required for the provision of our contractual services and online services, if the consent of the users has been obtained, or also on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation and security of our services within the meaning of Art. 6 Para. 1 letter f GDPR, in particular in the measurement of reach, the creation of profiles for advertising and marketing purposes and the collection of access data and the use of the services of third-party providers).

  8. We would like to point out that the legal basis for the consent is Art. 6 Para. 1 lit. a and Art. 7 GDPR, the legal basis for the processing for the fulfilment of our services and implementation of contractual measures is Art. 6 Para. 1 lit. b GDPR, the legal basis for the processing for the fulfilment of our legal obligations is Art. 6 Para. 1 lit. c GDPR and the legal basis for the processing for the protection of our legitimate interests is Art. 6 Para. 1 lit. f GDPR.

§ 2 Safety measures


We take organisational and technical security measures in accordance with the state of the art to ensure that the regulations of the data protection laws are observed and thus to protect the data processed by us against accidental or intentional manipulation, loss, destruction or access by unauthorised persons.

 

§ 3 Passing on of data to third parties and third-party providers

  1. Data will only be passed on to third parties within the framework of the legal requirements. We only pass on user data to third parties if this is necessary for contractual purposes, e.g. on the basis of Art. 6 Para. 1 letter b GDPR, or on the basis of justified interests in the economic and effective operation of our business operations in accordance with Art. 6 Para. 1 letter f GDPR. This applies to internal and external service providers for contract handling and order processing.

  2. If we use subcontractors to provide our services, we take appropriate legal precautions as well as appropriate technical and organizational measures to ensure the protection of personal data in accordance with the relevant statutory provisions.

  3. If, in the context of this data protection declaration, content, tools or other means are used by other providers (hereinafter referred to as "third parties") and their registered office is in a third country, it is to be assumed that a data transfer to the countries in which the third parties are based is taking place. Third countries are countries in which the GDPR is not a directly applicable law, i.e. generally countries outside the EU or the European Economic Area. Data is transferred to third countries either if there is an appropriate level of data protection, user consent or legal permission.

§ 4 Contacting us


When contacting us (via contact form or e-mail), the user's details are processed for the purpose of handling the contact request and its processing in accordance with Art. 6 Para. 1 lit. f GDPR.

 

§ 5 Use of Cookies

  1. Cookies are small amounts of data that are transferred from the internet to your computer together with the data actually requested. This data is stored there and kept ready for later retrieval. DVV Media uses the following types of cookies for www.dvvmedia-webinar.com:

    1. Session cookies:

      These are cookies that are only stored on your computer for the duration of an Internet session. These cookies are deleted when the session is ended, i.e. when you leave the website or when you close the browser window.

    2. Login cookies:

      A cookie is also used for user authentication. Different cookies can be used for this purpose: By default, cookies are used which are only generated for the respective session. They store information about the user name, user rights and the validity of the session.

    3. The web analysis tool Econda (cf. §7 item 2.) can set cookies to enable the recognition of an internet browser.

    4. Google-Re/Marketing Services:
      On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f GDPR) we use the marketing and remarketing services (hereinafter "Google Marketing Services") of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter "Google").
      Google's marketing services allow us to display ads for and on our website in a more targeted manner, so that we only show users ads that potentially match their interests. For example, if a user is shown ads for products that he or she has been interested in on other websites, this is known as "remarketing". For these purposes, when you access our and other websites on which Google Marketing Services are active, Google will execute code directly by Google and (re)marketing tags (invisible graphics or code, also known as "web beacons") will be embedded in the website. With their help, an individual cookie, i.e. a small file, is stored on the user's device (instead of cookies, comparable technologies can also be used). The cookies can be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. This file records which websites the user has visited, what content he is interested in and which offers he has clicked on, as well as technical information on the browser and operating system, referring websites, visiting time and other information on the use of the online offer. The IP address of the user is also recorded, whereby we inform within the framework of Google Analytics that the IP address is shortened within member states of the European Union or in other states that are party to the Agreement on the European Economic Area and only in exceptional cases is it transferred in full to a Google server in the USA and shortened there. The IP address is not merged with user data within other Google offers. Google may also combine the above-mentioned information with information from other sources. If the user subsequently visits other websites, the ads tailored to his interests can be displayed.
      User data is processed pseudonymously as part of Google Marketing Services. This means, for example, that Google does not store and process the name or e-mail address of the user, but processes the relevant data cookie-related within pseudonymous user profiles. This means that, from Google's point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who that cookie holder is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymisation. The data collected by Google Marketing Services about users is transmitted to Google and stored on Google servers in the USA.
      We may include third-party advertisements based on the Google Marketing Services "DoubleClick". DoubleClick uses cookies to enable Google and its partner websites to serve ads based on users' visits to our website or other websites on the Internet.
      We may serve ads to third parties based on Google Marketing Services "AdSense" ads. AdSense uses cookies to enable Google and its partner websites to serve ads based on users' visits to our website and other websites on the Internet.
      We may also use the "Google Tag Manager" to integrate and manage Google's analysis and marketing services on our websites.

e. Google Analytics Cookies (data collection for optimization purposes):

On the basis of our legitimate interests (i.e. interests in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f GDPR) we use Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics uses cookies, i.e. text files which are stored on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, since we have activated IP anonymisation on this website, your IP address will first be shortened by Google within member states of the European Union or in other states which are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and only shortened there. Google will use this information on our behalf to evaluate your use of the website for us, to compile reports on website activity for the website operator and to provide other services related to website and internet use. This website uses Google Analytics reports on demographic characteristics, in which data from interest-related advertising by Google and visitor data from third parties (e.g. age, gender and interests) are used. This data cannot be traced back to a specific person and can be deactivated at any time via the ad settings.   1. In general, you also have the possibility to delete cookies via the corresponding browser function and to set how your browser should handle cookies. However, it should be noted that the use of the services can be impaired if cookies are generally rejected.

§ 6 Use of Social Media Buttons

  1. On the basis of its legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f GDPR), DVV Media uses plug-ins of the AddThis service at www.dvvmedia-webinar.com, which is operated by AddThis, LLC, 1595 Spring Hill Rd, Suite 300, Vienna, VA 22182, USA ("AddThis"). AddThis provides tools for the creation and design of websites (www.addthis.com), which should make it easier for website visitors to share the current page with other internet users via e-mail or in social networks. The plugins can be found in the "share function" of our articles with the options "Whatsapp", "Facebook", "Twitter", "LinkedIn" and "Xing". AddThis also provides tools for website operators, which should help to analyze and improve the use of their own website or to enable direct user contact. AddThis also uses cookies and web beacons (small graphics, "counting pixels", which enable log file recording and log file analysis). If you use an AddThis plugin, your internet browser will establish a direct connection to the servers of AddThis and, if applicable, to the selected social network. The data generated (such as time of use or browser language) is transferred to AddThis and processed there.     You can also completely prevent the loading of the AddThis plugins with add-ons for your browser, e.g. with the script blocker "NoScript" http://noscript.net/.

  2. DVV Media uses the so-called Shariff solution. This solution ensures that initially no personal data is passed on to the social media providers when you visit the DVV Media website. Only when you click on one of the social plugins can data be transferred to the service provider and stored there.

  3. this website integrates a "YouTube plugin" into its information offering on the basis of legitimate interests (i.e. interest in the analysis, optimisation and economic operation of the online offering within the meaning of Art. 6 para. 1 lit. f GDPR). This YouTube software uses cookies for data collection and statistical data evaluation. YouTube uses cookies to collect reliable video statistics, to prevent fraud and to improve user-friendliness, among other things. YouTube cookies provide the website operator with statistical values for retrieving individual videos embedded in the website without any reference to the respective user. YouTube's embedded videos are used to the extent permitted by YouTube, which all users must accept. If you see any copyright infringement, please report it directly to YouTube.

  4. We use embedded YouTube videos in enhanced privacy mode. This means that YouTube does not store cookies for a user who is viewing a website with an embedded YouTube video player, but does not click on the video to start playback. When the YouTube video player is clicked, YouTube may store cookies on the user's computer, but no personally identifiable cookie information is stored for embedded video playback.   5. We use the provider Vimeo for the integration of videos. Vimeo is operated by Vimeo, LLC with headquarters at 555 West 18th Street, New York, New York 10011.
    We use plugins from the provider Vimeo at www.dvvmedia-webinar.com. When you access the Internet pages of our website that are equipped with such a plugin, a connection to the Vimeo servers is established and the plugin is displayed. This tells the Vimeo server which of our Internet pages you have visited. If you are logged in as a member of Vimeo, Vimeo assigns this information to your personal user account. When you use the plugin, such as when you click on the start button of a video, this information is also assigned to your user account. You can prevent this assignment by logging out of your Vimeo user account before using our website and deleting the corresponding cookies from Vimeo.

§ 7 Analysis services

  1. We use content and service offers from third parties within our services on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art.6 Paragraph 1 letter f GDPR) in order to integrate their content and services.

  2. For the purpose of designing and optimising this website in line with requirements, anonymised data is collected and stored using solutions and technologies from econda GmbH, Eisenlohr Straße 43, 76135 Karlsruhe, (www.econda.de) and user profiles are created from this data using pseudonyms. For this purpose cookies can be used which enable the recognition of an internet browser. However, user profiles are not merged with data about the bearer of the pseudonym without the visitor's express consent. In particular, IP addresses are rendered unrecognisable immediately after receipt, which makes it impossible to assign user profiles to IP addresses. We use the services of B2B Media Group EMEA GmbH, a provider of web analysis and target group marketing, on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer in the sense of Art. 6 Paragraph 6 1 lit. f GDPR). B2B Media Group EMEA GmbH uses so-called cookies, a text file that is stored in the computer's browser and collects/contains anonymous usage data. This data can be used to create usage profiles under a pseudonym. However, no personal data is collected without the consent of the person concerned. If IP addresses are collected, they are stored anonymously by deleting the last number block and are not merged with the cookies. The cookies are either cookies from B2B Media Group EMEA GmbH or cookies from service providers who are also obliged to comply with the data protection laws used by B2B Media Group EMEA GmbH, such as krux digital Inc.   5. IP anonymization:
    We have enabled IP anonymization on this website. This means that your IP address will be truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before it is transmitted to the USA. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on the website activities and to provide further services to the website operator in connection with the use of the website and the Internet. The IP address transmitted by your browser within the scope of Google Analytics is not combined with other data from Google.

§ 8 Webinars


DVV Media uses the software GoToWebinar from the provider LogMeIn Ireland Limited (contract processor) to conduct webinars. Personal data is collected/stored during the registration process on the infrastructure of LogMeIn (Bloodstone Building Block C70 Sir John Rogerson's Quay Dublin 2, Ireland). This includes, in particular, last name, first name, company, function, industry, address and email address. The legal basis for data processing is Art. 6 para. 1 lit. b of the Basic Data Protection Regulation.
The processing of the data by LogMeIn (as a processor) is based on Article 28 of the Basic Data Protection Regulation. The data is processed within the legally permissible framework in Germany, the European Union and the USA. An adequate level of protection has been established for data processing in the USA by agreeing to the EU standard contractual clauses. The deletion of data is carried out in accordance with the legal retention periods.
DVV Media will only use the data for a purpose other than the aforementioned purpose of fulfilling the contract or transfer the data to other third parties if this is legally permissible or the user has expressly consented to this.

 

§ 9 Usage-based online advertising

§ 12 Deletion of data


The data stored with us will be deleted as soon as they are no longer required for their intended purpose and the deletion does not conflict with any legal storage obligations. Provided that user data are not deleted because they are required for other and legally permissible purposes, their processing is restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to user data that must be retained for commercial or tax law reasons.

 

§ 13 Right of objection


Users can object to the future processing of their personal data in accordance with the legal requirements at any time. The objection may in particular be made against processing for the purposes of direct advertising.

We process inventory data as well as contract data for the purpose of fulfilling our contractual obligations and services, Art.6 para.1 lit. b GDPR.

For registration and participation in a webinar, the following data is collected, stored and processed: surname, first name, company, function, industry, address and e-mail address. These data are necessary for the execution of the webinar.
